CONFERENCE PARTICIPANT AGREEMENT Agreement (the “Agreement”) is to communicate our mutual expectations and the terms and conditions for participating in the Conference. If there’s anything you’re uncomfortable with, please let us know. We want to make sure we are on the same page moving forward.

This ticket is NON REFUNDABLE, however it is 100% transferrable.

In exchange for participating in the Conference, you agree to be bound by the following conditions.

Contractual Terms

1. Parties. This Agreement is made between Amy Rost, a sole proprietorship operating in the Province of Alberta (“ARC Pilates/Pilates Fest North “we”, “us”, and “our”) and you, the undersigned (electronically or by hand) or person who has clicked “I Agree” to this Agreement (“you” and “your”).

2. Conference. Pilates Fest North/ARC Pilates promises to provide you with an in-person Conference (the “Conference”) as outlined in Schedule “A” Conference.


3. What We Expect of You. Here is what we expect of you to ensure the best possible Conference for you and all the participants:

3.1. Time Integrity. Let’s honour our time together. Please arrive on time and honour the length of the Conference.

3.2. Communication. We expect you to be upfront and honest about how your mind and body feels, and any needs we can help with. We can’t help if I don’t know what you are experiencing!

3.3. Ownership. You are responsible for your own physical, mental and emotional well-being and actions during the course of the Conference.

3.4. Respect. You agree to be mindful and respectful of other participants, instructors and facilitators during and after the Conference.

4. Payment. Payment details for the Conference are outlined in Schedule “A” Conference.

5. Refunds. Our refund policy is as follows: All sales are final. Sales are non-refundable, but transferable.

6. Term & Termination. The term of this Agreement will begin on the date of execution by both parties and will continue until the end of the Conference (the “Term”). We may terminate this Agreement immediately if you fail to adhere to the expectations as outlined in Section 3 above and no refund will be provided.

6.1. Cancellation by Us. If ARC Pilates needs to cancel the in-person Conference, please note that the Conference will take place virtually. You will be notified of the virtual Conference 7 days prior to the Conference date.

7. Ownership of Intellectual Property. All materials provided in connection with the Conference including without limitation, written or printed documents, photographs, audio and video recordings and software, and all copies and derivative works relating thereto (the “Conference Materials”), are and will remain the sole and exclusive property of ARC Pilates. You have a limited, non-exclusive right to use the Conference Materials to the extent necessary to complete the Conference. An example of something you are not allowed to do with the Conference Materials would be to create a photocopy or reproduce the Conference Materials and give it to a friend or sell it to someone; another example would be to use the Conference Materials to create your own Conference, or to provide the Conference Materials to someone who intends to do so.

8. Media Release. You understand that ARC Pilates may use photos, audio or video of you as a means to document, share and promote ARC Pilates and the Conference. Please let us know if you do not want us to share any media of you and we will happily refrain from doing so and keep the camera off of you. Please know any such sharing will be used for marketing and promotional purposes only.

9. COVID-19/Infectious Disease. Amidst the current developments surrounding communicable diseases, you acknowledge that by participating in the Conference you affirm that you are healthy and that you do not present an increased risk due to COVID-19 or other infectious diseases. If you are suffering from symptoms of a communicable disease or are unsure of your health and ability to partake in the Conference, please consult with your doctor and you must inform us immediately. You further agree to follow the relevant guidelines and comply with studio policies around COVID-19, including use of masks or other protective gear, social distancing and hygiene practices.

10. No Guarantees. ARC Pilates cannot guarantee any particular success from the Conference. While you will receive the support and teaching to gain as much as you can from the Conference, the results ultimately depend on additional factors, including your commitment to the Conference.

11. General Indemnity. You hereby fully indemnify ARC Pilates and any of its members, directors, officers, employees, contractors, volunteers, agents, executors, administrators, successors, family members and assigns (the “Indemnified Parties”) and save harmless the Indemnified Parties from any losses, claims, damages, actions, causes of action, costs and expenses that an Indemnified Party may sustain, incur or suffer at any time, either during or after the Term, which are based upon, arise out of or occur, directly or indirectly, from your participation in the Conference.

12. Standard Legal Things.
Jurisdiction. This Agreement will be governed exclusively by the laws of the Province of Alberta.
Severability. If any provisions of this Agreement are invalid or unenforceable, the other provisions in the Agreement will remain in full force and effect.
Entire Agreement. This Agreement constitutes the entire Agreement between the parties and replaces any prior agreements.
Waiver of Breach. The waiver by me of any breach by you of any provision of this Agreement will not be taken to be a waiver of any further breaches by you.
Notice. For the purpose of this Agreement, e-mail or text will suffice for written notice when required as set out above.
Headings. The headings used in this Agreement are for stylistic purposes only and none of the
content in the headings are intended to be legally binding.
Counterparts. This Agreement may be signed in any number of counterparts, each of which is an original, and all of which taken together constitute one single document.
Online Agreement. We agree that this Agreement may be signed electronically or agreed to by having you click “I Agree,” the effect of which will be the same as if we signed this Agreement by hand and the intention of which is that both parties desire to be bound by all the terms of this Agreement.
